What do project teams need to consider in site design due to Florida's changing stormwater rules?

Florida's updated nutrient-based stormwater requirements have raised the standard for water quality treatment, making onsite compliance more difficult for many commercial developments, industrial facilities, roadway improvements, and multifamily projects. For sites where every acre matters, larger treatment footprints can reduce the amount of developable land, increase design complexity, and create additional long-term maintenance obligations.

As a result, project teams are beginning to ask a different question: Does this project need to solve water quality onsite, or is there another path to compliance?

Florida's emerging Water Quality Enhancement Area (WQEA) program is designed to give permittees another option.

Stormwater compliance is becoming a project planning decision

The most significant change isn't the creation of WQEAs. It's when project teams should begin thinking about stormwater compliance.

Historically, many stormwater decisions happened during engineering design. Once the project footprint was established, designers worked to fit treatment systems into the remaining available space. Today, that sequence may no longer produce the best outcome.

Projects that require more extensive nutrient treatment may benefit from evaluating both onsite and offsite compliance options before significant engineering begins. Waiting until permit drawings are nearly complete may limit flexibility, increase redesign costs, or require dedicating additional acreage to treatment infrastructure.

This means considering three pathways: traditional onsite treatment, participation in a Regional Stormwater Management System (RSMS—a shared treatment infrastructure serving multiple projects), or use of WQEA enhancement credits.

In other words, stormwater strategy is becoming an early project planning decision, not simply a design exercise.

 A new compliance pathway is taking shape 

Water Quality Enhancement Areas represent a different approach to meeting Florida's water quality requirements.

Rather than requiring every eligible project to construct all treatment onsite, WQEAs are regional, nature-based treatment systems designed to improve water quality across an entire watershed. These systems generate enhancement credits that eligible Environmental Resource Permit applicants may use to satisfy certain water quality treatment requirements.

The concept is straightforward. Instead of asking every development to build increasingly complex treatment systems on individual sites, regional treatment projects can provide verified water quality improvements where they deliver the greatest benefit.

For some projects, that may preserve developable land. For others, it may simplify long-term operations and maintenance. Most notably, the use of a WQEA enhancement credit transfers legal responsibility for the applicable water quality treatment requirement from the credit user to the WQEA operator. That makes WQEAs more than another environmental credit. They represent another project delivery option.

The regulatory framework is moving quickly

While final implementation details are still being developed, the program itself is no longer theoretical.

Recent legislation requires the Florida Department of Environmental Protection (FDEP) to adopt final WQEA rules by October 1, 2026. Until those rules are finalized, FDEP is authorized to accept provisional permit applications for qualifying WQEAs, allowing projects to move forward while rulemaking continues. Enhancement credits issued under provisional permits will continue to be recognized even if permit conditions are later modified to align with the final rules.

At the same time, FDEP is developing the regulatory framework governing enhancement credit generation, service areas, financial assurances, monitoring, and long-term stewardship.

The opportunity is emerging now, even as the regulatory details continue to evolve.

Like mitigation banking, location will matter

One of the most important things project teams should understand is that WQEA enhancement credits are not expected to function as a statewide commodity.

Credit availability will depend on several factors, including hydrologic service areas, pollutant type, and receiving water conditions. In most cases, service areas will follow HUC-8 watershed boundaries—the regional hydrologic districts that FDEP uses for water quality planning.

That means the best compliance strategy for one project may not be the best strategy for another located only a few counties away.

It also means early evaluation matters. Understanding whether enhancement credits may become available within a project's service area is far easier before design decisions have already been made.

The question isn't whether to buy credits

The better question is whether onsite treatment is the right solution in the first place.

Every project will be different.

Some developments will continue to derive the greatest value from traditional on-site stormwater systems. Others may benefit from Regional Stormwater Management Systems (RSMS). Some may ultimately be good candidates for WQEA enhancement credits, while others may combine multiple approaches.

The key is to evaluate those options early enough to influence project design, not simply react to permit requirements.

That shift in timing may prove to be one of the most important changes resulting from Florida's updated stormwater framework.

Looking beyond permit compliance

Although much of the conversation around WQEAs has focused on developers and permit applicants, the opportunity extends well beyond individual projects.

Engineering firms advising clients on ERP strategies will need to understand when regional treatment may create value. Municipalities and public agencies may identify opportunities to address water quality at the watershed scale rather than on a project-by-project basis. Landowners may determine that their property is well-suited to support future WQEAs, creating long-term environmental and economic value through regional treatment infrastructure.

Like mitigation banking before it, the WQEA market will require both project owners seeking compliance solutions and organizations willing to develop the regional infrastructure that enables those solutions.

Helping project teams evaluate their options

As Florida's WQEA program continues to develop, one thing is becoming increasingly clear: the most valuable decision may not be choosing a compliance tool. It may be understanding all of the available options before significant engineering begins.
